Walworth man charged with sexually assaulting 10-year-old
ELKHORN—A Walworth man faces possible life in prison after being charged with sexually assaulting a 10-year-old child, according to a criminal complaint.
Jose A. Vergara-Posada, 35, is charged with felony repeated sexual assault of a child, which carries up to a life sentence with the chance of extended supervision only after serving 25 years in prison.
Vergara-Posada of 257 Fox Lane also faces up to 25 years in prison on an additional felony charge of child enticement and up to three years and six months in prison on a felony charge of exposing his genitals to a child, according to the criminal complaint and online court records.
On April 7, village of Walworth police spoke to a Walworth Elementary School counselor, who said the now-10-year-old student put a note in a mailbox used by students to share confidential information with counselors and teachers, the complaint states.
The student later told a counselor that while at a baby sitter's home in summer 2014, Vergara-Posada took the child and a now-8-year-old child into a bedroom, locked the door and touched them under their clothes while holding their wrists, the complaint states.
The 10-year-old told police the touching happened four to five times between June 2014 and September 2014 and that Vergara-Posada threatened to kill the child's family if the child said anything, according to the complaint.
Vergara-Posada is free on a $5,000 cash bond, online court records state. He will appear in court next at 9:30 a.m. Thursday, May 12, at the Walworth County Judicial Center.
