Alfredo E. Villarreal, identified as the inmate shot and killed Jan. 21, 2013 by a Walworth County sheriff's deputy during an altercation at Aurora Lakeland Medical Center in Elkhorn.

— A Walworth County Sheriff's deputy who fatally shot an 18-year-old prisoner at Aurora Lakeland Medical Center was considered justified in using deadly forces, according to a report released today from Walworth County District Attorney Dan Necci.

Necci said Walworth County Deputy Sheriff Richard Lagle was repeatedly attacked by Alfredo Villarreal while the prisoner was being treated at the hospital for a fall he had taken in his jail cell Jan. 21.

Lagle had been kicked in the face by Villarreal hard enough to break his nose, then attacked with a chair.

Lagle attempted to use a Taser on Villarreal, but the Taser didn't work. Lagle then shot Villlarreal, who was attempting to escape.

Necci called the incident tragic, but unavoidable.
